1. Who we are and what these terms cover
These Terms and Conditions govern your access to and use of Serana websites and apps, including seranatx.com and book.seranatx.com, affiliated pages and booking platforms, and your booking and stay at properties owned or operated by Serana LLC and its affiliates.
“Serana,” “we,” or “us” means Serana LLC and its affiliates. “You” means the person accessing the site and, when applicable, the person booking or staying at a Serana property and everyone in their party.
2. Acceptance and when these terms apply
By accessing or using the site, you accept these terms. They become a binding contract when you confirm a reservation through book.seranatx.com or a third-party booking platform such as Airbnb. If you do not agree, do not book or use the site.
Clicking “Book,” “Confirm,” “Pay,” or a similar button when booking directly serves as your electronic signature and acknowledgement of these terms. A confirmation through a third-party platform constitutes acceptance of both these terms and that platform's terms.
If you reserve on behalf of other guests, you represent that you have authority to bind the entire party, accept responsibility for their compliance, and agree to share these terms with them before arrival.
We may post revised terms at any time. Unless stated otherwise, revisions apply to new bookings made after their effective date.
3. Eligibility and guest responsibilities
- Guests must be at least 21 to book or be accompanied by a parent or legal guardian.
- A valid payment method in the booker's name is required.
- Illegal substances are prohibited on Serana property.
- You are responsible for your party's conduct and for following rules provided on the site, in confirmation emails, or on posted signage.
4. Booking channels and third-party platforms
You may book through book.seranatx.com or a third-party platform such as Airbnb. The platform's terms apply in addition to these terms. If they conflict, these terms govern your relationship with Serana concerning your stay and property use.
5. Rural setting and safety
Serana operates on rural, partially undeveloped land in Central Texas. Uneven terrain, wildlife, insects, changing weather, and other outdoor hazards may be present. Shared kitchens, saunas, trails, glamping tents, Kampinas, and common areas are used at your own risk. You are responsible for using ordinary caution and following posted rules and staff guidance.
6. House rules
Weapons. Weapons of any kind are prohibited, including firearms, air guns, tasers, pepper spray, ammunition, and replicas.
Smoking. Smoking and vaping are prohibited inside every building. Smoking must occur at least 25 feet from structures, with all waste properly disposed of. A fee of $150 per affected night may be charged if smoke is detected inside a unit.
Wildlife and environment. Do not feed, touch, harm, or harass wildlife. Secure food and trash, do not damage vegetation or property, and take reasonable precautions against mosquitoes, ticks, fire ants, and other insects.
Cleanliness and damages. Keep spaces clean and return them in substantially the condition found. You authorize Serana to charge the payment method on file for excessive cleaning, repairs, replacements, rule violations, and other disclosed fees caused by you or your party.
7. Payment authorization and damages
You authorize Serana to place holds and charge your payment method for stay charges, taxes, disclosed fees, incidentals, missing items, and damage attributable to you or your party, whether you booked directly or through a third party. Reasonable charges may be based on repair or replacement value, professional invoices, or market estimates, plus a reasonable administrative fee.
8. Health, contagious illness, and shared facilities
Shared facilities may expose guests to contagious illnesses. Serana uses reasonable cleaning practices but cannot eliminate every risk. You remain responsible for your health decisions and precautions.
9. Activities and amenities
Hiking, sauna use, yoga, weight training, campfires where permitted, and other recreational activities involve risks such as slips, falls, heat exposure, dehydration, equipment failure, and wildlife encounters. Participation is voluntary and at your own risk. Follow all instructions and do not use an amenity if a health condition makes participation unsafe.
10. Assumption of risk
You knowingly and voluntarily accept all known and unknown risks associated with outdoor and recreational activities, rural conditions, wildlife, weather, terrain, and use of Serana facilities and amenities, including risks of illness, injury, property damage, and death.
11. Release and waiver of claims
To the fullest extent permitted by law, you, on behalf of yourself and your heirs, guests, and assigns, release Serana LLC, its affiliates, owners, members, managers, officers, directors, employees, contractors, and agents from claims arising from your access to the site, booking, stay, or use of Serana property, facilities, or amenities, including claims alleging negligence by a released party.
This release does not apply to liability that cannot lawfully be waived, including gross negligence or willful misconduct where a waiver is prohibited.
12. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Serana LLC and the other released parties from losses, liabilities, damages, claims, fines, penalties, costs, and reasonable attorneys' fees arising from:
- Your breach of these terms or property rules.
- Injury or property damage caused by you or your party.
- Your use of the site, property, facilities, or amenities.
This indemnity applies to the maximum extent allowed by law even when a claim alleges negligence by an indemnified party.
13. No warranties
The site, property, facilities, amenities, and information are provided “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or noninfringement. We do not warrant uninterrupted or error-free operation or that the site or property will be free of harmful components.
14. Limitation of liability
To the fullest extent permitted by law, Serana is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, loss of use or data, lost profits, or business interruption, even if advised that they are possible. Serana's total liability arising from the site, a booking, or a stay will not exceed the amount paid to Serana for the stay giving rise to the claim.
Some jurisdictions do not allow certain limitations. Nothing in these terms limits liability that cannot legally be limited.
15. Check out, eviction, and refunds
Failure to follow rules or instructions may result in immediate eviction without a refund. Serana may refuse service or end a stay to protect health, safety, or property. Refund eligibility follows the cancellation and refund policy disclosed by the booking channel used.
16. Force majeure
Serana is not responsible for delay, cancellation, or inability to perform caused by circumstances outside its reasonable control, including weather, natural disaster, utility outage, epidemic, government action, labor action, or equipment failure.
17. Dispute resolution, arbitration, and class action waiver
You and Serana agree that disputes arising from these terms, the site, a booking, or a stay will be resolved by binding individual arbitration in Texas through a reputable provider under its applicable commercial or consumer rules. Judgment on an award may be entered in a court with jurisdiction. Both parties waive a jury trial, and arbitration may proceed only on an individual basis.
Class, consolidated, and representative actions are not permitted. You may opt out of arbitration by sending written notice within 30 days of first accepting these terms.
18. Governing law and venue
Texas law governs these terms without regard to conflict-of-law principles. Any claim not subject to arbitration must be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to their personal jurisdiction.
19. Severability and survival
If a provision is unenforceable, it will be modified only as much as necessary and the remainder will stay in effect. Provisions that by their nature should survive will do so, including risk, release, indemnity, liability, governing-law, dispute, and payment-authorization provisions.
20. Entire agreement and priority
These terms, supplemental rules, and the booking confirmation form the entire agreement between you and Serana concerning the site and your stay and replace prior understandings. If a conflict exists, these terms control your relationship with Serana.
